All online retail sales available under and through this website, owned by Valrhona Selection FZE, are operated by Truebell Marketing & Trading L.L.C, a distributorship company established with limited liability company in the Emirate of Sharjah, under trade license number 17080, located at Sheikh Mohammed bin Zayed Street, Industrial Area No. 13, PO Box 4146, Sharjah, United Arab Emirate.

These Conditions of Sales shall apply to all online sales made under this Website.

For any sale of products available under and through this Website, the terms “we”, “us”, “our” and “Truebell” refer to Truebell Marketing & Trading L.L.C.

Any breach or violation of any of these Conditions of Sales will result in an immediate termination of the Website offered services.

I. Retail access

The online retail sales available on this Website are solely for the benefit of individual consumers. Professionals or resellers shall contact Valrhona to be directed for their purchases to : valrhona-collection@truebell.org

Truebell reserves the right to refuse the retail service to anyone for any reason at any time.

 

 

As a Purchaser you represent and warrant that:

you are at least the age of majority in the UAE and under your own personal status’ law;

You are making the purchase from the UAE for a delivery in the UAE;

you may not use the products for sale on the Website for any illegal or unauthorized purpose under any laws in your jurisdiction (including copyright laws);

you do not intend to resale to third-parties the products for sale on the Website;

We undertake no responsibility if the information made available on this Website is not accurate, complete or up-to-date at the time of your Order or visit. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information at any time.

Subject to applicable (1) consumer protection laws and (2) advertising or labelling laws any non-regulated information in this Website is deemed provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting more complete or more timely sources of information.

Efforts have been made to display as accurately as possible the colours, images and rendering of our products but we cannot guarantee that display of any colour on your computer/tablet/phone screen will match accurately.

We reserve the right, on a case-by-case basis or by policy, to limit the sales of our products in quantity of items by customer.

Products offers are valid as long as they are visible on the Website but always subject to the limit of available stocks. Products may be discontinued at any time.

In case of the unavailability of all or part of the products ordered, no modification of the order other than the unavailable part of the products will be accepted unless expressly agreed in advance.

 

We reserve the right to modify the contents of this Website at any time and shall have no obligation to update any information on our site.

III. Prices

Prices are subject to change without notice.

Prices are inclusive of VAT.

We try keeping our prices up to date on the Website but when changes occur, they may not be reflected instantly. Therefore, prices are always given as an information only and are always subject to confirmation before confirmation of your order from our side.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

IV. Orders

Orders must be solely placed online at www.valrhona-collection.ae.

We reserve the right to refuse any Order you place with us (whether for lack of stock or price changing or any other reason at the time of confirmation).

We also reserve the right, at discretion, to limit or cancel quantities purchased per person, per household or per order (This applies to orders made under the same customer account or name, the same credit or payment card or APM account, and/or orders that use the same billing and/or shipping address.

Orders that appear, in our sole judgment, to be placed by resellers or distributors will not be entertained.

An order reference number will be allocated to the Customer upon validation of the Order and acceptance of its payment.

The order confirmation, together with its reference number, will be displayed at the end of the online purchase process and will also be sent to the Customer by email.

Should the payment be refused at any stage beyond confirmation, the Order will be automatically cancelled, and the Customer will be informed through e-mail.

Unless otherwise agreed by us, upon acceptance of the Customer’s payment the Order shall be deemed final on the Customer’s side with no right of retraction or cancellation.

In the event that a change or cancellation is required from our side we will notify you by e-mail or phone number through the details you provided at the time the order was made.

 

 

All sales made through this Website are between Truebell (as Seller) and the Customer (as Buyer).

Valrhona Selection FZE is not a party to any online sale agreement concluded through this Website.

V. Customer Information

Submission of personal information from the Customer during the ordering and sale procedure under this Website is governed by our Privacy Policy.

To protect your personal information as per applicable personal data protection laws, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

You agree to provide current, complete and accurate information for all purchases that you make with us including in terms of contact and delivery. We shall not bear any responsibility in case we cannot reach you or in case we cannot deliver your purchase by lack of concise delivery location details.

You agree to promptly update your account and other information, including your email address and phone numbers, so that we can complete your transactions and contact you as needed.

VI. Payment

Payment will made through a third party payment processor: Telr.

Credit/Payment cards information is always encrypted during transfer over our internal or third-party networks.

If you provide us with your credit/payment card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.

Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all requirements and implement additional generally accepted industry standards.

VII. Delivery

We deliver our Products to all cities in the UAE. Shipping will be done by a third-party courier.
Delivery within Dubai shall be within 24 hours, delivery outside of Dubai will be within 48 hours. UAE Delivery Fees will be a Flat Rate of AED: 20 for orders under check out value of AED 200 and Delivery Fees is free if check out value is over AED 200. Avoid any delivery delay by providing your full address along with your contact details.

Truebell we will do its best at any time to ensure your satisfaction.

 

VIII. Refund Policy

Refunds will be done only through the Original Mode of Payment and will be processed within 10 to 45 days depends on the issuing bank of the credit card

Due to the nature of our products, please check and confirm your items on delivery.

Make sure to raise any delivery or quality concern at the time of delivery to the delivery person or not later than 2 hours after delivery for concerns which could not be detected upon delivery.

Unsatisfactory items may be returned to the delivery person at the time of the delivery.

In case of any problem with your Order, please send us an email with your Order confirmation number on valrhona-collection@truebell.org or call us at 058 298 3377 and we will assist you.

We may, at your option but always subject our approval of the claim, either replace items, if they are defective or damaged, or proceed to a refund.

If you did not receive your Order or if you have received an incorrect Order, you may be issued a full refund.

If part of your Order is missing, we may issue a partial refund, as deemed appropriate.

Once your claim or the return is received and inspected, we will send you an email to notify you of the approval or rejection of your refund.

Accepted refunds will automatically be applied to your original method of payment. Should this be impossible we will contact you to find an alternative method.

This may take a certain number of days.

You may also be proposed, instead of receiving a refund, the option to receive a credit note voucher in your Customer account which will be valid for your next purchase on our Website.

Gifts are not subject to refunds. They only give right to replacement.

 

IX. Return Policy 

We accept returns within 7 days of receipt, only if the delivery packaging has not been opened or the products are damaged or wrong product. Please notify us and return the box in its original packaging. In such instances, we will endeavour to send you replacemnt or refund the payment. We can only accept returns of products that have not been tampered with, are sealed and remain in the original packaging. If all these conditions are met, please ship your products back to us using a registered courier service and we will issue a full refund. Please note that we reserve the right to refuse any returned shipments if the product has been used or tampered with. Shipping & Handling fees are non-refundable.

 

X. Cancellation policy 

Customer can cancel their order within 12 hours provided the order has not been dispatched for delivery; refunds will be made back to the payment solution used initially by the customer. Please allow for up to 45 days for the refund transfer to be completed.

 

XI. Complaints – Consumer protection

We pride ourselves at handling Customer complaints seriously and timely in line with our obligation under the UAE Federal Law No. 15 of 2020 on Consumer Protection.

All of the content featured or published on this Website, including, but not limited to, applications, graphics, illustrations, images, photographs, texts, softwares and videos (‘content’), is owned by Valrhona Selection FZE and its licenced content providers.

The Website as a whole and in any portion is protected by copyright law, registered and unregistered trademarks, database rights and any other applicable intellectual property rights.

XIII. Disclaimer

We cannot guarantee, represent or warrant that your use of our Website will be uninterrupted, timely, secure or error-free.

We reserve the right to remove access to the Website for indefinite periods of time or to cancel the Website services at any time, without notice.

XIV. Termination

These Conditions of Sales shall be effective unless and until terminated by either you or us.

You may terminate these Conditions of Sales at any time by notifying us that you no longer wish to use the services of our Website.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Conditions of Sales, we may also terminate this agreement at any time without notice and accordingly deny your access to our Website services including your Customer account (save as required under applicable data protection laws during the archiving time of your data).

XV. Limitation of liability - Indemnity

To the extent permitted by law, the contractual liability of Truebell for any Order shall always be limited to the total amount of such Order.

In no case shall Truebell, its directors, officers, employees, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, arising from your wrongful use of any of the services or products sold or supplied through using this Website.

You agree to indemnify, defend and hold harmless Truebell and Valrhona Selection FZE and their parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Conditions of Sales and associated Website Policies or your violation of any law or the rights of a third-party.

Failure by us to exercise or enforce any right or provision of these Conditions of Sales shall not constitute a waiver of such right or provision.

These Conditions of Sales, as updated from time to time and associated with all other Website policies or related operating rules (such as for payment) constitute the entire agreement and understanding between you and us and govern your use of the Website, superseding any other communication, whether oral or written, between you and.
